Port Orange, FL - A Port Orange man faces charges after firing a gun near officers and then reaching for a beer during a tense standoff.

The Port Orange Police Department received a call regarding a neighbor threatening someone with a gun.

Upon arrival, officers reported that the suspect, identified as Brett McPeek, discharged a firearm near officers and bystanders who were outdoors at the time.

Following the gunshot, officers located McPeek outside his residence, holding two beers.

Body camera footage captured an officer approaching McPeek with a drawn weapon.

The exchange highlighted McPeek's concerning behavior, with statements like "This beer is cold, sir. I wanna drink it" and "Come check me. I wanna drink this beer, is that cool? I haven’t done nothing wrong."

Officers engaged in negotiations with McPeek before ultimately taking him into custody.

Although no firearm was found on McPeek at the time of arrest, a search of his residence revealed two guns, including a .38 caliber revolver with a spent shell casing.

McPeek was arrested on charges of aggravated assault with a firearm and using a firearm while intoxicated.

He was booked into the Volusia County Branch Jail with no bond set.
