TAMPA, Fla. (WFLA.com) - Richard McTear Jr., who is accused of throwing a baby out a car window, will get his day in court again. Jury selection will start Monday.

McTear Jr. will stand trial for the death of 3-month-old Emmanuel Murray, who was found on the edge of Interstate 275 in Tampa nearly five years ago.

Last year, jurors were only one day into McTear's first trial before a mistrial was declared. Monday begins round two. Hillsborough state prosecutors and McTear's attorneys will begin the task of selecting a new jury.

Prosecutors claim McTear Jr. is responsible for throwing the baby out the window on I-275. Four words from McTear as he was led to jail became forever linked to the case.

"It's a dirty game," McTear said.
